1 - Website publisher

The www.lordsofwatch.com website, hereinafter referred to as “this website” is published by the WK company, SAS with a share capital of 25,000 Euros, registered to the RCS of Lille, France.

The website was jointly made by the WK company (conception), Karbone 14 (graphical creation) and accessite.net (technical implementation).

3 - Terms of use

3.1 - Protection of intellectual property and copyright

The structure of “this website” as well as the texts, images, sounds and videos it comprises are the property of the WK company. Any partial or complete reproduction of “this website”, by any means, is forbidden and constitutes counterfeiting - an offence which incurs a criminal conviction according to Articles L.335-2 and following and according to the Code de la Propriété Intellectuelle.

The texts, images, sounds, videos and other documents present on “this website” are protected by industrial and/or intellectual property right either because the WK company is their holder or because it has the rights to reproduce or represent them.

Consequently, any reproduction, representation, adaptation, translation and/or complete or partial modification or transfer towards another website is forbidden - except with prior, explicit and written authorization from the WK company previously requested by e-mail at contact@lordsofwatch.com.

The copy on paper medium, for private use, of these various objects of law is authorized according to Article L122-5 from the Code de la Propriété Intellectuelle.
Brands and logos on “this website” are registered by the companies which own them. Any reproduction, republication or redistribution of names and logos, by any means and without prior explicit and written notice by their holders, is forbidden by law.

3.2 - Responsibilities and guarantees

Functioning

Access to “this website” is available 24 hours a day and 7 days a week, except in cases of force majeure or of an event outside the control of the WK company and under reserve of any breakdowns and maintenance interventions necessary for the proper working of “this website”.

Access to “this website” is possible via a terminal connected to a telecommunication network allowing access to “this website” according to the communication protocols used on the Internet network.

The consultation of “this website” and the use of its functionalities are free.

Reliability of information

“This website” is for informational purpose only and may evolve or change. The WK company cannot be held responsible for any damage or losses, true or alleged as a result of or relating to its usage.

As noted in the corresponding pages, new (not second-hand) watch prices mentioned on “this website” are provided for information purpose only, for the French market, do not commit brands and may be modified without notice. Therefore, we advise users to contact an authorized shop  to get any price confirmed.

Similarly, even if the WK company tries to ensure that the second-hand/vintage watch prices are as accurate as possible, these are also provided for information purpose only and should not be used as the only aspect of a buying decision. The WK company cannot be held responsible for any shortfall of earnings or losses, true or alleged as a result of or relating to the use of these prices.

Concerning the content provided by users, the WK company cannot be held responsible neither for the nature of this content, nor for any damage or losses, true or alleged as a result of or relating to its usage.

Hyperlinks on “this website” may redirect to other websites or other Internet sources. Provided that the WK company cannot control these websites or external sources, it cannot be held liable for making access to these websites or external sources available and cannot be held accountable for their content, adverts, products, services or any other material available on or available from these websites or external sources. In addition, the WK company cannot be held liable for any damage or losses, true or alleged as a result of or relating to their usage or to the fact that trust had been placed in the contents or services available on these websites or external sources.

Finally, to the extent permitted by law, the WK company cannot be held liable should the content of these other websites or Internet sources be in violation of current laws and regulations.

Subscription and cancellation

> Private individuals

To access some of the functionalities of “this website” (information details on watch models, ratings, watch and shop ratings), the user must register to create a “Lords of Watch” account and become a member.

Registration can be performed directly on “this website” or by connecting an account from Facebook via “this website” as described above.

It is indeed possible to link a “Lords of Watch” account to a Facebook account by authorizing “this website” to get access to the Facebook account according to the Terms of use governing it. The user declares being authorized to disclose their Facebook account login details/to give to “this website” access to its Facebook account without infringing the Terms of use that govern it and without committing the WK company to any fees. By authorizing “this website” to get access to their Facebook account, the user understands that “this website” will have access to the content provided and kept on their Facebook account so that it will be available on and via their “Lords of Watch” account.

 The WK company will never consult the Facebook content of the user, including checking its accuracy, legality and non-infringing character. Therefore, the WK company denies any responsibility towards the contents of the user’s Facebook account.

If a Facebook account becomes unavailable or if the access of “this website” to the account is revoked, the content provided and kept on the Facebook account will no longer be available on and via the corresponding “Lords of Watch” account. The user can deactivate the connection between their “Lords of Watch” account and their Facebook account at any time from the home page of their “Lords of Watch” account by clicking on the “disconnect” button.

The “Lords of Watch” account is created so that the user can use “this website” according to personal data which they have provided or obtained via Facebook as described above. A user cannot have more than one (1) active “Lords of Watch” account. The user agrees to provide accurate, up-to-date and complete information during the registration process and to update the said information to maintain its accuracy, relevance and completeness.

The WK company has the right to suspend or terminate the “Lords of Watch” accounts of a user who would have created more than one (1) “Lords of Watch” account or if any information provided during the registration procedure or thereafter shall prove to be inaccurate, outdated or incomplete.

The user is responsible for the protection of their password and agrees not to disclose it to any third party. The user is responsible for any activity or action on their “Lords of Watch” account, may those aforementioned activities or actions have been authorized or not. Any unauthorized use of one’s “Lords of Watch” account must be notified by e-mail at  contact@lordsofwatch.com.

The WK company has the right to limit, suspend, disable or terminate your access to your “Lords of Watch” account at any time, without notice, for any reason under these Conditions. In such cases, the user will not be able to access their “Lords of Watch” account and its content.

The user can delete their “Lords of Watch” account at any time via the “Delete the account” function, found on the homepage of their professional “Lords of Watch” account or by sending an e-mail to contact@lordsofwatch.com. If a professional “Lords of Watch” account is canceled or deleted, the WK company cannot be liable to delete or send back any content posted on “this website” by the user in question, including the shop card, except if such request is made by e-mail at contact@lordsofwatch.com.

> Professional users

To get access to the professional functionalities of “this website” (creation and administration of a shop card including replies to ratings or posting of professional adverts), a professional user must register to create a professional “Lords of Watch” account and become a professional member.

Registration is performed directly on “this website” but can also initiated by connecting a Facebook account via “this website”.

The WK company has the right to suspend or terminate the “Lords of Watch” accounts of a professional user who would have created more than one (1) “Lords of Watch” account - professional or not - or if any information provided during the registration procedure or thereafter shall prove to be inaccurate, outdated or incomplete.

The professional user is responsible for the protection of their password and agrees not to disclose it to any third party. The professional user is responsible for any activity or action on their “Lords of Watch” account, may those aforementioned activities or actions have been authorized or not. Any unauthorized use of one’s “Lords of Watch” account must be notified by e-mail at contact@lordsofwatch.com.

The WK company has the right to limit, suspend, disable or terminate your access to your professional “Lords of Watch” account at any time, without notice, for any reason, including but without limitation, breach of these Terms and Conditions. In such a case, the professional user will not be able to access their “Lords of Watch” account and its content.

The professional user can delete their “Lords of Watch” account at any time through the “Delete the account” function, found on the homepage of their professional “Lords of Watch” account or by sending an e-mail to contact@lordsofwatch.com. If a professional “Lords of Watch” account is canceled or deleted, the WK company cannot be liable to delete or send back any content posted on “this website” by the professional user in question, including the shop card, except if such request is made by e-mail at contact@lordsofwatch.com.

Contribution and validation

Each private user with a “Lords of Watch” account can contribute through the provided functions to give information on watches, rate and evaluate watches and shops.

Each published contribution is going through a validation step beforehand. However, the contributions are posted under the sole responsibility of the user and the WK company will not be liable for it.

Users must abide by the following contribution guidelines:

Show good manners: on “this website”, it is possible to add information, to rate, to evaluate watches and shops. All these actions must be carried out in the respect of others: don’t depreciate, ridicule and swear.

Be law-abiding: all contributions of pornographic (including nudity) or violent nature, as well as those that infringe rights of privacy or the dignity of a human person will be rejected.

Hypertext links towards other websites or other Internet sources are welcomed as long as their content does not infringe legal dispositions and rules applied and that their goal is not to promote or advertise for competitors.

Discretion: this website is open to the general public. Therefore, as a measure of precaution, it is strongly advised not to reveal too much personal information. Contributions revealing personal contact details (e-mail, address, phone number) will be rejected.

If a user considers that the rejection of one of their contributions was not justified, they can write an e-mail to contact@lordsofwatch.com

The WK company has the right to limit, suspend, disable or terminate your access to a “Lords of Watch” account at any time, without notice, if repeated infringements of these contribution guidelines are committed.

3.3 - Terms of use of the ad publishing service

Ad publishing

“This website” does not accept the publishing of ads for original products. The selling of counterfeit products may be punished under article L. 335-2 alinéa 2 of the French Code de la propriété intellectuelle and result in a 300 000 euros fine and imprisonment for a term of two years.

Ads must be written in French as a legal obligation imposed by the French law n°94-345 of August 4th, 1994 and their corresponding text must describe the product being sold. Non-compliant ads (including ads that are promotional, making publicity, containing key words which do not describe the product, containing a link pointing to another ads website) will systematically be rejected.

Any proposed ad may be rejected, with or without motive, without the user being able to demand any indemnity.

Any published ad may be rejected, with or without motive, with or without notice, without the user offering the ad being able to demand any indemnity.

By default, ads are displayed on “this website” in chronological order, from the newest to the oldest; users reading the list of ads benefit from sorting and scheduling functionalities to amend the sorting order and facilitate their search.

Obligations of the users of the ad publishing service

To use the ad publishing service, the user must have a “Lords of Watch” account, either as private individual or as a professional.

Any user of the ad publishing service must ensure that the product they wish to sell is indeed authorized on “this website” and especially that it is not a copy or counterfeit product.

The user of the ad publishing may only publish one (1) ad per product. The user of the ad publishing service may only offer one (1) product per ad.

The user of the ad publishing service must delete all obsoleted ads, mentioning in the deletion form whether the product was sold or not and, where appropriate, the selling price of the product; this information will help to adjust second-hand/vintage prices depending on the real selling prices of products.

3.4 - Personal data

Policy

“This website” respects the privacy of Internet users who visit it and is in line with the current laws regarding personal data protection.

Personal data that any user might have to transmit will fall under the dispositions of the French law Loi n° 78-17 Informatique et Libertés du 06 janvier 1978.

Thus, the user has a right to access, modify or delete data concerning them that they can exert at any time by e-mailing contact@lordsofwatch.com.

Nature of collected personal data

Information that we may be collecting comes from :
- The voluntary registering of an e-mail address that enables you to receive our newsletter.
- The complete filling in of your contact details in our contact form.

Use of collected data

Information transmitted by users are never given away to third parties. Depending on the situation, uses are listed below:

When subscribing to our newsletter, the e-mail address of the user will be used for our emailing campaigns. Each user can, at any time, unsubscribe from our newsletter by clicking on the mention “Unsubscribe here” that can be found on each emailing campaign or by sending us a request to unsubscribe by e-mail at contact@lordsofwatch.com.

When creating a “Lords of Watch” account, the e-mail address of the user can be used for sending messages coming from potential commercial partners. The user can evidently refuse that their contact details are used for sending that kind of messages by ticking the box provided on the registration page. If at the time of their registration, the user accepted to receive third party messages and that they don’t want to any longer, they can modify the sending parameters in their account.

The WK company can also give certain information to its technical partners in order to enable the user to enjoy certain functions of “this website”. However, these vendors are not authorized to make any usage of this data.

Cookie

When a user browses on “this website”, a cookie is sent on to their computer. This cookie does not allow to identify the user but to record certain information (preferences, visited pages) in an anonymous way to facilitate browsing on “this website” for future visits, from the same computer. This information is kept on the computer for thirty (30) days. Any user can configure their web browser to reject all cookies or to indicate when a cookie is being sent. However, please note that some features of the service may not function in their entirety if the ability to accept cookies is disabled.

3.5 - Changes to services or to Terms and Conditions

The WK company may, at any time and at its sole discretion, discontinue “this website” or any part thereof without prior notice.

The WK company may also, at any time and at its sole discretion, change some or all of the Terms and Conditions. The WK company advises its users to regularly review the present Terms and Conditions in order to be aware of potential changes. The use of “this website” by users constitute the acceptance by the latter of any changes made to the Terms and Conditions.

3.6 - Applicable law

The aforementioned Terms and Conditions are governed by French law, even if one of the Parties is of foreign nationality and/or the contract is executed totally or partially abroad.
Any dispute that cannot otherwise be resolved amicably, any interpretation or execution difficulties, will be dealt with by courts in France.
